Terms & Conditions
These Terms & Conditions form a legally binding agreement between Next Trekking (the Company) and you (the Client) for trekking and travel services originating in Nepal. By booking, you confirm that you have read and agree to these terms, which are governed by the laws of Nepal and intended to comply with applicable consumer, contract, e-commerce, and privacy requirements.
1) Booking & Payment
Nepal Trips: A non-refundable deposit of 30% of the total trip cost is required to secure a booking. The remaining amount is payable at the pre-trip briefing upon arrival in Nepal, or by card/bank transfer before arrival.
Last-Minute Bookings: Nepal — accepted up to 10 days before departure (subject to availability); Bhutan/Tibet — up to 20 days before departure. In both cases, full payment is required at booking and is non-refundable.
Currency: Prices are quoted in USD. If you pay in NPR or other currencies in Nepal, conversions use the Nepal Rastra Bank (NRB) official rate applicable on the processing date. Any bank or gateway fees are the client's responsibility.
2) Client Responsibilities (Passport, Visa & Permits)
You are responsible for holding a passport valid for at least six months beyond your return date and for obtaining the appropriate Nepal visa and trekking permits. Visa-on-arrival is generally available to eligible nationals; always check official guidance before travel. Restricted-area treks and certain regions require special permits issued via licensed agencies and a licensed guide.
3) Unforeseen Circumstances
Our trips comply with destination regulations. However, itineraries may change due to events beyond our control, including government rule changes, political events, strikes, adverse weather, pandemics, client health issues, accidents, road closures, flight delays/cancellations, and natural disasters (e.g., earthquakes, landslides, floods, snowfall, avalanches). Any additional costs arising from such events are borne by the client. The Company will assist with documentation for insurance claims, where applicable.
4) Risk & Responsibilities
Adventure travel includes inherent risks, including but not limited to personal injury, illness, death, or property loss from altitude, weather, forces of nature, and transport limitations. While the Company takes reasonable measures for safety, you accept these risks. Nothing in these Terms limits rights or remedies that cannot be excluded under applicable Nepalese consumer law.
5) Mandatory Travel Insurance
Comprehensive travel insurance is mandatory for all clients and must cover high-altitude trekking, medical treatment, repatriation, helicopter rescue/air ambulance, trip interruption/cancellation, and baggage loss/theft. You are responsible for confirming adequate coverage for the specific itinerary and elevation.
6) Domestic Flight Delays & Helicopter Options (Everest/Lukla and similar)
Weather in mountain regions is unpredictable; domestic flights (e.g., to/from Lukla) are frequently delayed or canceled. If a chartered helicopter is required to maintain your schedule, it may be arranged on a shared basis (typically up to five passengers). All helicopter costs are payable by the client at market rates (commonly from about USD 550 per person one way, subject to season, load, and availability). Helicopter costs are in addition to any flight tickets. Your travel insurance may reimburse eligible costs; we provide receipts and letters to support claims.
7) Changes to Trip & Pricing
If an itinerary must be canceled or altered due to unforeseen events (e.g., disasters, airline changes), we will offer an equivalent-value alternative or reschedule. When rescheduling, you must cover services already used and any price difference if the new departure is higher-priced. Most packages are priced on twin/double sharing; a single-room supplement applies if a suitable roommate is unavailable.
8) Health & Fitness
High-altitude trekking requires good physical and mental health. Consult your physician before travel. Walking times in itineraries are averages and vary by individual fitness and trail conditions. Disclose any pre-existing conditions when booking so we can advise on suitability and preparation.
9) Children
Participants under 16 years must be accompanied by a parent or legal guardian.
10) Privacy & Publicity
We process personal data in accordance with Nepal's privacy laws; see our Privacy Policy. With your consent, we may capture and use photographs/video from trips for our website and social media. You may withdraw consent at any time (this will not affect materials already published).
11) Complaints
Please raise any concerns promptly with your guide or our office so we can seek a timely resolution. If not resolved on trip, contact us via the website form with details and supporting evidence.
12) Acceptance of Terms & Client Conduct
These terms apply to direct bookings with the Company. If you book through an agent or third party, their terms also apply. We may remove any client whose behavior is illegal, unsafe, or severely disruptive; unused services will not be refunded, and you will be responsible for any resulting costs or damages.
13) Governing Law & Jurisdiction
These Terms are governed by the laws of Nepal. Disputes are subject to the courts of Kathmandu Valley (District, High Court, and Supreme Court, as applicable).
